These Terms of Use ("Terms") govern your access to and use of the website tideclub.com.au (the "Website") operated by Tide Marine Services Pty Ltd (ABN 16 694 884 323), trading as Tide ("we," "us," or "our").
By accessing or using our Website, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced in these Terms. If you do not agree to these Terms, you must not use our Website.
We reserve the right to update or modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last Updated" date. Your continued use of the Website after any changes constitutes your acceptance of the revised Terms.
2. Our services
Tide provides boat hire and boat detailing services in South East Queensland. Our Website allows you to learn about our services, submit enquiries, request quotes, and make bookings.
Specific terms and conditions apply to each of our services:
- Boat hire: All boat hire bookings are subject to our Boat Hire Terms, which form part of these Terms.
- Boat detailing: All detailing services are subject to our Detailing Service Terms, which form part of these Terms.
In the event of any inconsistency between these Terms and a service-specific policy, the service-specific policy prevails to the extent of the inconsistency.
3. Eligibility
You may browse our Website regardless of age. However, you must be at least 18 years of age and have legal capacity to make a booking, request or accept a quote, enter into a service agreement, or otherwise purchase Services from Tide.
If you submit an enquiry or booking request on behalf of another person or organisation, you represent that you are authorised to do so.
Additional eligibility requirements may apply to specific services. For example, boat hire requires a valid Queensland Recreational Marine Driver Licence (RMDL) for vessels with engine power greater than 4.5kW, as set out in our Boat Hire Terms.
4. User conduct
When using our Website, you agree that you will:
- Provide accurate, current, and complete information in any forms or communications
- Use the Website only for lawful purposes and in accordance with these Terms
- Not use the Website in any way that could damage, disable, or impair the Website or interfere with any other person's use of the Website
You must not:
- Attempt to gain unauthorised access to any part of the Website, other accounts, computer systems, or networks connected to the Website
- Use any automated means (including bots, scrapers, or spiders) to access the Website or collect information from it
- Introduce any viruses, malware, or other harmful material to the Website
- Use the Website to transmit any unsolicited advertising or promotional material
- Impersonate any person or entity, or misrepresent your identity or affiliation with any person or entity
5. User-submitted content
Our Website may allow you to submit content, including photographs of your boat, written descriptions, notes, and other materials ("User Content").
You retain ownership of your User Content. You represent and warrant that you own or have the necessary rights and permissions to submit the User Content, and that your User Content does not infringe the intellectual property rights or other rights of any third party.
By submitting User Content to us through the Website, you grant Tide a non-exclusive, royalty-free licence to use, reproduce, store, modify, adapt, publish, display, and distribute your User Content for purposes connected with providing, administering, documenting, and improving our Services. This includes using User Content to prepare quotes, manage service records, assess vessel condition, communicate with you, and keep internal records.
We may also ask for your consent to use User Content for marketing, advertising, or promotional purposes, including on our Website, social media channels, print materials, and third-party platforms. We will only use identifiable User Content for marketing purposes where we have your consent or where otherwise permitted by law.
If you would like to withdraw your consent for marketing use of your User Content, please contact us at info@tideclub.com.au. Withdrawal of marketing consent will not affect our use of your content for service delivery, record-keeping, legal, insurance, dispute-resolution, or other legitimate business purposes.
We are not obligated to use any User Content, and we may remove any User Content from our Website or marketing materials at our discretion.
6. Intellectual property
All content on our Website, including text, graphics, logos, images, photographs, videos, designs, and software (excluding User Content), is owned by or licensed to Tide and is protected by Australian and international intellectual property laws, including the Copyright Act 1968 (Cth) and the Trade Marks Act 1995 (Cth).
You may view and download content from our Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from our Website without our prior written consent.
The Tide name, logo, and all related names, logos, product and service names, designs, and slogans are trade marks of Tide Marine Services Pty Ltd or its affiliates. You must not use these marks without our prior written permission.

Our Website may contain links to third-party websites, platforms, or services that are not owned or controlled by us. We are not responsible for the content, privacy practices, or availability of any third-party websites. 8. Payments
Where our Website offers payment functionality (now or in the future), the following terms apply:
- All prices displayed on our Website are in Australian dollars and include GST unless otherwise stated
- We use third-party payment processors to handle transactions securely. Your payment information is collected and processed by these third parties in accordance with their own privacy and security policies
- We do not store your full credit card or bank account details on our systems
- Additional payment terms may be set out in the relevant service-specific terms (such as our Boat Hire Terms or Detailing Service Terms)
9. Limitation of liability
Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable law that cannot be excluded, restricted, or modified by agreement.
Website and general information: To the maximum extent permitted by law, we do not warrant that our Website will be available at all times, uninterrupted, error-free, secure, or free from viruses or other harmful components. Information provided on our Website is general in nature and should not be relied upon as professional, legal, safety, maritime, or technical advice.
Service-specific terms: Boat hire and boat detailing involve practical, physical services and may carry risks that are addressed in the relevant service-specific terms, including our Boat Hire Terms and Detailing Service Terms. Those service-specific terms apply in addition to these Terms. If there is any inconsistency between this section and a service-specific policy or agreement, the service-specific policy or agreement prevails to the extent of the inconsistency.
To the maximum extent permitted by law, and subject to the paragraphs above:
- For claims arising from your use of the Website or reliance on general Website information, our total aggregate liability to you is limited to $100 AUD
- For claims arising from paid Services, our liability is governed by the relevant service-specific terms and, where liability can lawfully be limited, is limited to the amount you paid to us for the relevant Service giving rise to the claim
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, opportunity, or business interruption, arising out of or in connection with your use of the Website or Services
- We are not liable for any loss or damage resulting from circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, fire, flood, government actions, marine park or waterway closures, mechanical failure, pandemic, industrial disputes, or interruptions to utilities or telecommunications (see Section 10)
Where our liability for breach of a consumer guarantee cannot be excluded but can be limited, our liability is limited (at our option) to supplying the relevant services again or paying the cost of having the relevant services supplied again.
10. Force majeure
We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: severe weather or adverse marine conditions, natural disasters, fire, flood, pandemic or epidemic, government orders or restrictions, marine park or waterway closures, mechanical failure of vessels, acts of war or terrorism, industrial disputes, or interruptions to utilities or telecommunications.
Where a force majeure event affects our ability to provide a booked service, we will notify you as soon as practicable and work with you to reschedule or provide an alternative arrangement in accordance with the applicable service-specific terms.
11. Indemnification
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Tide, its directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Website or Services in breach of these Terms
- Your User Content, including any claim that your User Content infringes the rights of a third party
- Your violation of any applicable law, regulation, or the rights of any third party
- Any negligent, reckless, or wilful act or omission by you during the course of receiving our Services
This indemnification obligation survives the termination of these Terms and your use of the Website.
12. Dispute resolution
If you have a dispute with us arising out of or relating to these Terms or our Services, we encourage you to first contact us directly to attempt to resolve the matter informally. Please contact us at info@tideclub.com.au or 0485 670 603.
If we are unable to resolve the dispute informally within 14 days, either party may refer the dispute to mediation administered by the Resolution Institute (or its successor body). The mediation will be conducted in Brisbane, Queensland.
If the dispute is not resolved through mediation within 30 days of the referral, either party may pursue their legal rights and remedies.
Nothing in this section limits your right to commence proceedings in a court or tribunal of competent jurisdiction, including the Queensland Civil and Administrative Tribunal (QCAT), at any time.
13. Governing law
These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and any courts that may hear appeals from those courts.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid, illegal, or unenforceable provision will be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
15. Entire agreement
These Terms, together with our Privacy Policy, Boat Hire Terms, and Detailing Service Terms, constitute the entire agreement between you and Tide regarding your use of the Website and Services. These Terms supersede any prior agreements, understandings, or representations relating to the same subject matter.
16. Termination
We may suspend or terminate your access to the Website at any time, without notice, if we reasonably believe you have breached these Terms or for any other reason at our discretion. Upon termination, all provisions of these Terms that by their nature should survive will continue to apply, including intellectual property, limitation of liability, indemnification, and governing law.
